Fire fighting and prevention design approval

Appraisal and approval of designs on fire prevention and fighting mean a competent agency's examination and comparison of solutions and design contents of projects, works, and motor vehicles with special requirements on assurance of fire safety with regulations, standards, provisions of the law of Vietnam related to fire prevention or fighting or foreign standards, international standards on fire fighting and prevention are allowed to be applied in Vietnam according to the order and procedures prescribed by law.
Appraisal of fire fighting and prevention design is one of the jobs that are required for establishments, according to Decree 136/2020-ND-CP. The assessment and approval of the fire prevention and fighting design must be performed by a qualified design consultant and legal entity and then approved and accepted by the Fire Fighting and Prevention Police.
The appraisal and approval of fire fighting and prevention, project file and designs, projects, works or work items when building new, changing the nature of use, must have the design of fire prevention and fighting as a competent agency. Planned must be approved for fire protection before construction. The result of design appraisal of fire fighting and prevention is one of the bases for reviewing, approving regulations, approving projects, appraising construction designs and granting construction permits.

PROCEDURES FOR REQUESTING APPROVAL OF FIRE FIGHTING AND PREVENTION

Submit dossier

Agencies, organizations and individuals shall submit 1 set of dossiers of application for approval of fire fighting and prevention designs according to regulations to competent agencies in one of the following forms:

- Submit directly at One-Stop Department of the competent authority;

- Submit online at the Public Service Portal of the competent authority (for documents and papers on the list of state secrets, comply with the law on the protection of state secrets);

- Submit through the public postal service, through hiring services of businesses or individuals, or through authorization as prescribed by law.

Check dossier

The dossier-receiving officer is responsible for checking the composition and validity of the dossier and complying with the following regulations:

- In case the dossier is complete and valid as prescribed, the information shall be received and recorded in the receipt and settlement of administrative procedures on fire fighting and prevention

- In case the dossier is incomplete or invalid as prescribed, the instructions for completing the dossier shall comply with regulations and the information shall be recorded in the Instruction sheet for supplementing the dossier of request for settlement of administrative procedures on fire fighting and prevention

Announcement of the result of the processing

- In case the application is submitted directly to the One-Stop Department of the competent agency, the dossier-receiving officer must directly hand over 01 copy of the receipt for settlement of administrative procedures on firefighting or the instruction sheet provide additional guidance on the application for settlement of administrative procedures on firefighting to the person submitting the application and keep 01 copy;

- In case applied through the Public Service Portal of the competent authority, the receiving officer shall send a notification via email or phone message about the receipt or instructions on supplementing the dossier to the agency, organization, and person that has applied

- In case applied through the public postal service, through hiring services of businesses or individuals, or through authorization as prescribed by law, the dossier-receiving officer must send 01 copy of the receipt to handle administrative procedures on fire fighting and prevention or instructions for supplementing sheet dossiers of request for settlement of administrative procedures on fire fighting and prevention for those who submit dossiers and keep 01 copy;

- In case the application is not eligible (the project or work is not subject to the appraisal and approval of the firefighting design as prescribed in Appendix V of Decree 136/2020/ND-CP or is not under the competence of the Government) approval of the design of firefighting) must send a written reply to the agency, organization, or individual within the time limit on the refusal to process the dossier.

The competent authority shall reply to the agency, organization, or individual in the form corresponding to the form in which the agency, organization, or individual has previously submitted the dossier.

PROCEDURES FOR IMPLEMENTATION OF FIRE FIGHTING & PREVENTION DESIGN APPROVAL

Applying for fire fighting and prevention design approval consultancy is as simple as applying for a house construction permit.

After receiving the design, AMAVI will work directly with the state management agency in charge of fire fighting and prevention to submit the drawings for approval of fire fighting and prevention to see if they are correct and sufficient under the law on fire fighting and prevention requirements.

If the appraisal and approval procedures are satisfactory, the state management agency will issue a certificate of fire fighting and prevention appraisal and approval. At that time, the project owner will invite a contractor specializing in fire prevention and fighting to carry out the work. A supervisor could be rented to supervise the construction of the work they had designed.

After the construction is completed, the investor unit will make a dossier to request the fire protection agency to check and accept the completed work. If the requirements are met, it is considered to have completed the construction of fire prevention and fighting

Procedures for approval of a fire fighting and prevention project

Fire fighting design approval deadline

- Planning fire fighting and prevention design project: No more than 10 working days.

- Basic design: No more than 10 working days for projects of group A. No more than 05 working days for projects of groups B and C.

- Technical design or construction drawing design: No more than 15 working days for projects of group A. No more than 10 working days for projects of groups B and C.

- Approval of construction site: No more than 05 working days. The grouping of projects and works of groups A, B and C mentioned above shall comply with the Government's regulations on the management of construction investment projects.
